6.3 Refunds

Refunds are subject to our refund policy as outlined in our Policy & Procedure document. Generally, refunds are available within 7 days of enrollment if less than 25% of the course has been completed.

To the fullest extent permitted by law, Fortune Academy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Any unauthorized access to or use of our servers or your personal information
• Any interruption or cessation of transmission to or from our services
• Any bugs, viruses, or similar harmful code
• Any errors or omissions in content

Our total liability shall not exceed the amount paid by you to Fortune Academy in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Fortune Academy and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of our services or your violation of these Terms.

13.2 Arbitration

Any dispute arising from or relating to these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Myrtle Beach, South Carolina.

13.3 Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and Fortune Academy individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Modification of Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.
